This is the privacy statement of the private limited company rTMS International B.V., hereinafter: rTMS International. rTMS International is registered with the Chamber of Commerce under number 87691671 and is located at ‘s-Gravendijkwal 66, 3014 EG Rotterdam. This document explains how rTMS International handles the processing of your personal data. In processing your personal data, rTMS International exercises the greatest possible care.
What does rTMS International do
rTMS International is a medical service provider offering rTMS treatments.
Collection of personal data
If you make use of the services of rTMS International, you provide personal data to rTMS International yourself. The processing of your personal data is necessary to be able to offer you the required and/or desired services. Personal data means all data relating to an identified or identifiable natural person.
Categories of personal data
rTMS International processes the following categories of personal data:
Name and address details – including at least your first and last name, your date of birth, and your address;
Contact details – email address and telephone number;
Citizen service number (BSN);
Identity document details (document number and expiry date);
Health insurance policy number;
Health data;
Living situation;
Marital status;
Religious beliefs;
Healthcare providers;
Other personal data you provide yourself.
Purpose of processing
The personal data processed by rTMS International is intended to:
Execute and provide services;
Calculate, record, and collect fees;
Conduct scientific or statistical research;
Comply with legal obligations;
Improve the website by analysing visitor behaviour;
Send newsletters (if subscribed).
Basis for processing
The processing of personal data is only possible on the following grounds: (i) legal obligation, (ii) performance of an agreement, (iii) obtained (explicit) consent from the data subject, and (iv) legitimate interest. When providing services, rTMS International processes personal data. rTMS International processes only the data it deems necessary for the provision of services and handles the personal data it has collected about you with care. The basis for processing this data is the agreement you have entered into with rTMS International and the legal obligation of rTMS International to process certain personal data. Your personal data may also be processed when visiting the website www.rtms-international.com if you have given permission for this.
Necessity of processing
The processing of your personal data is necessary to provide the services. The services offered by rTMS International cannot be fully carried out without processing your personal data. For example, no file can be created and no claims can be sent to your health insurer. In addition, as a medical service provider, rTMS International has a legal obligation to process certain data about you. If your explicit consent is required for specific purposes related to your personal data, you must provide this separately.
Automated decision-making
If any automated decision-making takes place, this is done by computer systems and/or software without human intervention. You are responsible for the data you provide and that is used during automated decision-making. If the data proves to be incorrect or incomplete, any resulting damage will be at your expense and risk. Damage also includes not, not timely, or incorrectly executing the agreement as a result of incorrect data. rTMS International does not use automated decision-making.
Retention period
The personal data processed by rTMS International is retained in accordance with relevant laws and regulations. If a longer retention period is necessary by virtue of laws or regulations, the personal data will be retained longer in accordance with these requirements. For medical records, a legal retention period of 20 years applies. All personal data collected is not retained longer than strictly necessary.
Processing by third parties
rTMS International only shares personal data with third parties if this is strictly necessary for the performance of an agreement and to comply with relevant laws and regulations. No personal data is sold. rTMS International has a legal obligation to share personal data with third parties. If personal data is shared with third parties, processing agreements are concluded for this, unless there is a legal basis for not doing so. The third parties with whom personal data is shared are:
Health insurers, on the basis of a legal obligation;
Healthcare providers, for the performance of an agreement;
IT systems suppliers, for the performance of an agreement;
The accountant, for the performance of an agreement.
Security of personal data
rTMS International takes the protection of your personal data seriously and, taking into account the state of the art, implementation costs, as well as the nature, scope, context, and purposes of processing, and the varying likelihood and severity of risks to the rights and freedoms of natural persons, takes appropriate technical and organisational measures to ensure a security level appropriate to the risk. The data is stored and hosted in at least a TIER III certified data centre located in the Netherlands.

rTMS International uses technical and functional cookies to optimise the website. Cookies are small text files sent along by visiting a website to make visitors’ user experiences more efficient. According to the law, rTMS International may store cookies on your device if these cookies are strictly necessary to use the website. For other types of cookies, your consent is required. rTMS International will stop processing the personal data unless there are compelling legitimate grounds for the processing which override the interests, freedoms, and rights of the data subject, or which are related to the establishment, exercise, or defence of legal claims.

If you have a complaint about the way rTMS International handles your personal data, or wish to exercise one of the above rights, you can contact the Data Protection Officer at [email protected]. To ensure that you wish to exercise a right, rTMS International asks you to enclose a copy of your identity document. You may black out your photo and MRZ (machine-readable zone, the strip with numbers at the bottom) to protect your privacy. rTMS International will respond to your request as soon as possible, but no later than within 4 weeks.
